1. Applicability of General Conditions of Sale

1.1 Each order placed shall be governed by the present General Conditions of Sale and subject to particular conditions applicable to orders placed via the Nuance online store: https://www.nuance.co.za

1.2 Nuance reserves the right to modify the present General Conditions of Sale at any time by publishing a new version.

2. Orders

2.1 You may place your orders via or online store: https://www.nuance.co.za

2.2 The minimum order value for free delivery is R1000 (after any applicable discounts).

Orders below a value of R1000 will incur a R100 shipping charge

2.3 Nuance offers its products within the limits of its available stocks.

2.4 Nuance reserves the right to refuse orders, notably in case of unpaid invoices insolvency, exceeding the bounds of fair use with respect to our exchange, refunds and cancellation policy.

3. Delivery

3.1 Nuance uses all reasonable efforts to ensure deliveries within 3 to 5 (three to five) working days. Delivery may take place out of the 5 working days for outer lying or regional areas.

3.2 Risk of loss and damage in goods passes to you on delivery.

4. Verification of Goods

4.1 It is your responsibility to verify the quantity and condition of the goods upon receipt and, in case of on-arrival damage or missing items, to reject the order.

4.2 Nuance shall in such circumstances provide you with identical replacement goods, credit or refund.

5. Exchange Policy

BUYER’S REMORSE

Goods may be returned within 14 days of purchase, provided they are unused and in saleable condition in original undamaged packaging.

DEFECTIVE GOODS

Out of Box Failure applicable to hardware items

Where there is an Out of Box Failure (OBF) within 14 days from date of purchase Nuance will accept a return for refund, replacement or repair at the buyer’s option provided that the item is returned together with:

– proof of purchase

– the original packaging and manuals

– any vouchers or other freebies that were part of the sale

After the First 14 Days but Within 6 Months of Purchase

Buyer may return goods if the goods are defective.

Where goods have been altered, tampered with or damaged by the buyer there is no right of return but goods may be repaired at the buyer’s cost. Nuance has the right to assess the goods to determine whether they are defective and the cause of the defect.

Buyer has the right to choose whether goods are replaced, repaired or refunded if the warranty claim is made within 6 months of purchase. Subject to proof of purchase (valid electronic receipt, printed receipt or invoice showing machine model, and date of purchase).

After 6 Months but Within Warranty Period Warranty/Guarantee period is 12 months in South Africa. Nuance decides whether defective goods are to be repaired, replaced or refunded if the warranty claim is made after 6 months.

6. Prices and Invoicing

6.1 The prices invoiced for the goods you order are those in effect on the date you place your order.

7. Payment

7.1 For Electronic payment, payment is due in full before ordered goods are dispatched.

7.2 Credit card payment must be made in full before ordered goods are dispatched.

7.3 Cheque and/or cash on delivery payments are not accepted.

8. Machine Guarantee and After-Sales Service

8.1 The Nuance machines are under 12 month parts and labour warranty against manufacturer defects from the date of purchase mentioned on the invoice.

9. Data Protection

9.1 Nuance does not sell your personal data to third parties and treats it in strict accordance with POPIA, applicable law and its privacy policy. The Nuance privacy policy is published here.

9.2 As per applicable law, you have the right to access and rectify personal data concerning you by contacting Nuance via enquiries@nuance.co.za for advice and assistance.

10. Applicable Law and Forum

10.1 The present General Conditions of Sales are governed by the law of the Republic of South Africa.

10.2 The courts of South Africa have exclusive jurisdiction.

11. Governing Laws and Jurisdiction

11.1 These terms and conditions shall be governed by and interpreted according to the laws of the Republic of South Africa. By accessing and using the Website, you consent to the exclusive jurisdiction of the High Court of South Africa
